Nu uita\u021bi ce ne-au \u00eenv\u0103\u021bat str\u0103mo\u0219ii no\u0219tri latini: \u201eVerba volant, scripta manent\u201d.<\/p>\n<p>Iat\u0103 care sunt elementele care nu trebuie s\u0103 lipseasc\u0103 dintr-un contract de \u00eenchiriere:<\/p>\n<ul>\n<li>\u00cen primul r\u00e2nd, <strong>p\u0103r\u021bile contractante<\/strong>. Trebuie avute \u00een vedere:\n<ul>\n<li>Valoarea chiriei lunare \u0219i moneda \u00een care se va face plata;<\/li>\n<li>Cursul de referin\u021b\u0103;<\/li>\n<li>Suma pl\u0103tit\u0103 la startarea contractului (de regul\u0103 se pl\u0103te\u0219te cu anticipa\u021bie chiria pentru una sau mai multe luni);<\/li>\n<li>C\u00e2t de des se va pl\u0103ti chiria (lunar, trimestrial, etc.)<\/li>\n<li>Intervalul de timp \u00een care se va face plata (de exemplu, \u201e\u00een intervalul 1-5 al fiec\u0103rei luni, pentru luna urm\u0103toare)<\/li>\n<li>Contul bancar \u00een care se face plata (al proprietarului sau al mandatarului acestuia)<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>Pe l\u00e2ng\u0103 drepturi, <strong>chiria\u0219ul are \u0219i urm\u0103toarele obliga\u021bii<\/strong>, ce trebuie stipulate \u00een contractul de \u00eenchiriere:<\/li>\n<li>S\u0103 se asigure de buna folosin\u021b\u0103 a imobilului \u00eenchiriat<\/li>\n<li>S\u0103 nu aduc\u0103 modific\u0103ri f\u0103r\u0103 acordul scris al proprietarului<\/li>\n<li>S\u0103 pl\u0103teasc\u0103 la timp utilit\u0103\u021bile consumate (ap\u0103, gaz, energie electric\u0103, internet, etc.)<\/li>\n<li>S\u0103 nu creasc\u0103 \u00een apartament animale de companie<\/li>\n<li>S\u0103 nu fumeze \u00een imobil<\/li>\n<li>S\u0103-i permit\u0103 proprietarului s\u0103 viziteze imobilul (la un interval de timp precizat)<\/li>\n<li>S\u0103 achite o garan\u021bie (\u00een bani) proprietarului.<\/li>\n<\/ul>\n<ul>\n<li><strong>Obliga\u021biile proprietarului<\/strong> sunt \u0219i ele men\u021bionate \u00een contractul de \u00eenchiriere:<\/li>\n<\/ul>\n<ul>\n<li>S\u0103 predea imobilul \u00een stare de folosin\u021b\u0103, pe baza unui proces verbal de predare-primire<\/li>\n<li>S\u0103 asigure chiria\u0219ului folosin\u021ba exclusiv\u0103 \u0219i pa\u0219nic\u0103 a imobilului<\/li>\n<li>S\u0103 repare \u0219i s\u0103 men\u021bin\u0103 \u00een func\u021bionare imobilul pe durata derul\u0103rii contractului<\/li>\n<li>S\u0103 inapoieze garan\u021bia, odat\u0103 ce chiria\u0219ul a pl\u0103tit integral chiria \u0219i utilit\u0103\u021bile consumate \u0219i dac\u0103 imobilul nu a suferit deterior\u0103ri.<\/li>\n<\/ul>\n<ul>\n<li><strong>Condi\u021biile \u00eencet\u0103rii sau relizierii contractului de \u00eenchiriere<\/strong> trebuie s\u0103 fie de asemenea prezentate. \u00cencetarea contractului se refer\u0103 la un acord \u00eentre cele dou\u0103 p\u0103r\u021bi, precum rezilierea este cerut\u0103 de una dintre ele, dac\u0103 cealalta nu \u0219i-a \u00eendeplinit obliga\u021biile contractuale. De exemplu, conform contractului, proprietarul are dreptul s\u0103 rezilieze contractul dac\u0103 locatarul a \u00eent\u00e2rziat cu plata chiriei mai mult de dou\u0103 s\u0103pt\u0103m\u00e2ni.<\/li>\n<li><strong>For\u021ba major\u0103<\/strong> (incendiu, cutremur, r\u0103zboi) face ca p\u0103r\u021bile s\u0103 fie exonerate de orice obliga\u021bile contractual\u0103 cu excep\u021bia datoriilor \u00eenregistrate p\u00e2n\u0103 la data evenimentului.<\/li>\n<\/ul>\n<ul>\n<li><strong>Elementele de contact \u0219i coresponden\u021b\u0103<\/strong> ale celor dou\u0103 p\u0103r\u021bi (nume, adres\u0103 po\u0219tal\u0103, adres\u0103 de email, num\u0103r de telefon, etc.)<\/li>\n<\/ul>\n<ul>\n<li><strong>Limba<\/strong> \u00een care a fost redactat contractul (preferabil rom\u00e2na).<\/li>\n<li><strong>Data semn\u0103rii contractului<\/strong><\/li>\n<\/ul>\n<ul>\n<li><strong>Locul semn\u0103rii contractului<\/strong>. Se recomand\u0103 ca semnarea s\u0103 se fac\u0103 \u00een prezen\u021ba ambelor p\u0103r\u021bi, dar sunt \u0219i situa\u021bii \u00een care este acceptat\u0103 semnarea \u201ela distan\u021b\u0103\u201d.<\/li>\n<\/ul>\n<ul>\n<li><strong>Inventarul bunurilor din imobil<\/strong>: o list\u0103-inventar a bunurilor \u0219i instala\u021biilor existente \u00een spa\u021biul \u00eenchiriat, al\u0103turi de starea lor de uzur\u0103.<\/li>\n<\/ul>\n<p>{:}{:en}Too many of those who sign a rental agreement don&#8217;t take seriously it&#8217;s content, relying too much on the impression their business partner left them. A rental agreements protects both the owner and the renter, since all the aspects of the situation are clearly stipulated in it so the problems that could appear along the way could be solved much easier. Besides, a rental agreement is a the guarantee of a fruitful collaboration. Remember what our latin ancestors taught us: &#8222;verba volant, scripta manent&#8221;.<\/p>\n<p><strong>Here is what a rental agreement must contain:<\/strong><\/p>\n<ul>\n<li>First of all, <strong>the contractual parties<\/strong>. Or, better, said, their ID card data. If a representive signs the contract he needs a mandate from a notary. If the mandate is issued outside the borders of a state, it needs to come from an Embassy or Consulate of the state in question. A mandate from Italy, for example, needs a signature, has to be translated and legalized by a notary. If one of the parties is a company, their ID data are the ones from the Trading Registry Office.<\/li>\n<\/ul>\n<ul>\n<li><strong>The object of the rental agreement. <\/strong>The estate that will be rented needs to be identified precisely. We&#8217;re talking about a full postal address and the cadastral number. Also, a short description would also be necessary, especially if only parts of the estate will be rented. In case of houses or villas, we recommend mentioning if the space around them will also be rented.<\/li>\n<li>After that, it needs to be settled the person who is going to use the rented space. It often happens that someone rents a property only to give it to a friend or family to use it. In this case, all the rights and obligations stipulated in the rental agreement belong to the person who signed it. If the renter is a legal entity, it needs to specify how many person will use the rented space.<\/li>\n<\/ul>\n<ul>\n<li><strong>The purpose of the lease<\/strong> also needs to be mentioned in the contract. Usually it is \u201efor living\u201d, but sometimes rented spaces are turned into offices or commercial spaces.<\/li>\n<\/ul>\n<ul>\n<li><strong>The rental period<\/strong> needs to be settled as well. The start date of the contract and it&#8217;s length will be stipulated precisely. It often happens that rental agreements aren&#8217;t delivered forward by the tenant. That&#8217;s why a warning notice has to be given in the contract, so the landlord has time to find another renter and the renter has time to find another place to live.<\/li>\n<\/ul>\n<ul>\n<li><strong>Value of rent and payment methords<\/strong> are two important points that don&#8217;t have to miss from a contract. Here is what they are about:<\/li>\n<li>value of the rent and currency in which payment will be made<\/li>\n<li>reference course<\/li>\n<li>the amount of money payed at the start of the rental agreement<\/li>\n<li>how often the tenant will pay the rent (monthly, quarterly, etc.)<\/li>\n<li>the time period in which the payment will be made<\/li>\n<li>the bank account in which the payment will be made (of the owner or his representative)<\/li>\n<\/ul>\n<ul>\n<li>Aside from rights, <strong>the tenant also has obligations<\/strong> that must be stipulated in the rental agreement. He must:<\/li>\n<li>make for of the good use of the property he rented<\/li>\n<li>not bring any changes to it without written consent from the owner<\/li>\n<li>pay the utillity bills on time<\/li>\n<li>not raise pets in the rented space<\/li>\n<li>not smoke in the rented space<\/li>\n<li>allow the owner to visit it in an previously announced time period<\/li>\n<li>pay a money guarantee to the owner<\/li>\n<\/ul>\n<ul>\n<li><strong>The obligations of the owner<\/strong> must also be mentioned in the rental agreement. He must:<\/li>\n<li>hand over the property in a good state of usage, based on a handover record<\/li>\n<li>ensure the exclusive and peaceful use of the property to the tenant<\/li>\n<li>fix and maintain the estate in good working during the contract period<\/li>\n<li>give the guarantee money back to the tenant once he paid the rent and utility bills, if the property suffered no damages<\/li>\n<\/ul>\n<ul>\n<li><strong>Conditions of termination or annulment of the contract<\/strong> must also be mentioned in the agreement. The termination of the contract is when both parties agree on it, while annulment is when one of the parties requests it, if the other one didn&#8217;t fullfil it&#8217;s contractual obligations.
